1. General Information

1.1 Binding Terms and Conditions
The GamezAddict Website is owned and operated by eQuad Technologies Sdn. Bhd. (“the Company”). These Terms and Conditions and notices issued therefrom together with any additional terms, codes of conduct or guidelines posted on the GamezAddict Website (collectively, the “Terms and Conditions”) shall apply to the GamezAddict Website and any information, products, software, contests, tournaments and services offered therein (the “GamezAddict Services”) but not to the content of third parties.
Your establishment of a GamezAddict Account (as hereinafter defined in these Terms and Conditions), your access to or use of the GamezAddict Website and / or the GamezAddict Services confirms your acknowledgement and acceptance to be bound without modification to these Terms and Conditions. You agree that no joint venture, partnership, employment, or agency relationship exists between you and the Company as a result of your establishment of a GamezAddict Account, your access to or use of the GamezAddict Website and / or the GamezAddict Services. In addition, the GamezAddict Website and the GamezAddict Services may contain additional terms, codes of conduct or guidelines that govern their use, including without limitation, particular features, offers, contests or tournaments. In the event that any of these Terms and Conditions conflict with the said other terms, codes of conduct and guidelines contained within the GamezAddict Website or the GamezAddict Services, then these Terms and Conditions shall prevail.

1.2 Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of England and are subject to interpretation according to the said laws. Your establishment of a GamezAddict Account, your access to or use of the GamezAddict Website and / or the GamezAddict Services confirms your acknowledgement and acceptance that any conflict or disagreement that cannot be resolved by the parties shall have to be settled individually and will not result in any form of class action. You further agree to submit to the exclusive jurisdiction of the English courts for the resolution of any dispute.

1.3 Updates and Modifications to Terms and Conditions
The Company reserves the right to update and / or modify, at any time and with reasonable notice, any part of these Terms and Conditions. You are responsible for regularly reviewing these Terms and Conditions from time to time. Your continued access to or use of the GamezAddict Website and / or the GamezAddict Services constitutes your agreement to all such modified Terms and Conditions. If you do not agree to any changes to any of such modified Terms and Conditions, then your sole remedy shall be to cancel your GamezAddict Account.

1.4 Entire Agreement
These Terms and Conditions represent the entirety of your agreement with the Company, and which cannot be modified by you. A printed version of these Terms and Conditions and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms and Conditions to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

1.5 Severability
If any provision or part thereof of these Terms and Conditions is deemed to be void or unenforceable, then that provision or part thereof shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of the remaining provisions.

2. Privacy Policy and Protection of Personal Information

2.1 The Company requires you to register with the GamezAddict Website in order to play its games, enter its contests or tournaments, win cash prizes and receive notifications of account matters. As part of the registration process, the Company requires you to submit your personal information, which will be used in accordance with this Privacy Policy as set out in these Terms and Conditions. The Company may need to obtain additional information relating to system software processes and / or hardware configuration information from your computer systems during game play to assist in ensuring a fair gaming environment.

2.2 The Company also collects anonymous information such as your IP address, the type of browser and operating system used, the pages you visit at the GamezAddict Website, prize winnings, and player game statistics. This anonymous information is not associated with your personally identifiable information and cannot be linked to you personally.

To conform to any legal requirement or comply with any legal process and / or investigation;

3. GamezAddict Account, User ID, Password and Security

3.1 You have to create a personal account at the GamezAddict Website (the “GamezAddict Account”) before you can access or use the GamezAddict Website and / or the GamezAddict Services. You must complete the registration process by providing current, complete and accurate information as prompted by the applicable registration form. You will then have to choose a password and a user name (the “User ID”). You are entirely responsible for maintaining the confidentiality of your User ID and password .

3.2 You are solely responsible for all obligations and are entitled to all benefits relating to your GamezAddict Account.

3.3 Furthermore, you are entirely responsible for any and all activities that occur under your GamezAddict Account. Your GamezAddict Account is not transferable to any other person. You are not allowed to permit any other person to access your GamezAddict Account, access or use the GamezAddict Website and / or the GamezAddict Services, accept any winnings, or participate in any contest or tournament using your GamezAddict Account information. You agree to notify the Company immediately of any unauthorised use of your GamezAddict Account or any other breach of security. The Company will not be liable for any loss that you may incur as a result of someone else using your GamezAddict Account, your User ID or your password , either with or without your knowledge. However, you could be held liable for losses incurred by the Company, its suppliers or licensors due to someone else using your GamezAddict Account, your User ID or your password. You may not use anyone else’s GamezAddict Account at any time .

3.4 Your establishment of a GamezAddict Account, your access to or use of the GamezAddict Website and / or the GamezAddict Services confirms your acknowledgement and acceptance that the Company may display your User ID and tournament scores and records on the GamezAddict Website. By accepting any prize from the Company, you further agree that the Company may, in its promotional efforts, use any form of media (newsletters, broadcasts, e-mails, etc.) to publish your User ID, tournament records and likeness without any compensation to you.

4. Eligibility

4.1 You must be a natural person of at least 18 years of age or be at an age required or allowed under applicable law for making a legal and binding contract in order to participate in any cash prize or other consideration-based contest or tournament at the GamezAddict Website. You are not eligible to play games that offer cash as prizes if you reside in the states of Arizona, Arkansas, Connecticut, Delaware, Florida, Iowa, Louisiana, Maryland, or Tennessee in the United States of America. You are also not allowed to play such games if you think or know that doing so may or will infringe the laws of the territory you reside in.

4.2 You must submit accurate registration information and are responsible for maintaining the accuracy of this information. If you deliberately submit misleading, incomplete and / or inaccurate information, the Company may forfeit any prizes that you may have won and / or terminate your GamezAddict Account.

4.3 You are only allowed to open and maintain a single GamezAddict Account. Your GamezAddict Account must be individually funded.

4.4 Employees, officers, and directors of the Company, as well as its subsidiaries and affiliates are not eligible to open accounts at the GamezAddict Website.

5. Game Play, Contests and Tournaments

5.1 The Company operates and maintains high score tables for free-play games with respect to each of the games offered at the GamezAddict Website. These tables will be updated regularly by the Company.

5.2 Descriptions, guidelines and rules for all games, contests and tournaments offered will be posted at the GamezAddict Website.

5.3 The winners of the contests and tournaments available at the GamezAddict Website will be determined by the scoring processes as defined by the Company.

5.4 The outcome of the various contests and tournaments available at the GamezAddict Website are directly related to the skill levels of the participants of a particular contest or tournament. Winnings (generally cash prizes) are deposited into the winners’ respective GamezAddict Accounts.

6. GA Reward Points

6.1 The GA Reward Points System allows you to collect valuable GA Reward Points when you play in selected contests or tournaments offered at the GamezAddict Website. All participants in such contests or tournaments will earn GA Reward Points that may be used to redeem prizes at the GamezAddict Website. The Company reserves the right to terminate or revise the terms of the GA Reward Points System and prize redemption values without notice.

6.2 Current information on the GA Reward Points System and redemption policies are published in the GA Reward Points Section of the GamezAddict FAQs.

6.3 The Company is not obliged to refund or credit any GA Reward Point that may have been lost or forfeited due to software malfunctions, server connection problems, or inadvertent redemption for prizes in the GamezAddict Website.

7. Technical Configuration

7.1 It is your sole responsibility to confirm the technical compatibility between your computer system and the GamezAddict Website. Please refer to the Technical Section of the FAQ's for information on the optimum computer specifications.

7.2 Your computer system also must have either Internet Explorer 5.x (or above) or Netscape Navigator 6.x (or above) and an e-mail software programme capable of sending and receiving e-mail from the Company via the Internet.

8. Deposits and Withdrawals

8.1 General
You agree that the Company shall not be liable for any loss caused by any unauthorised use of your credit card or any other payment mechanisms by any third party in connection with payments to and from the Company via the GamezAddict Website.
Any attempt to defraud the GamezAddict Website and / or the Company through the use of credit cards or other payment mechanisms, regardless of the outcome, or any failure by you to honour legitimate charges or requests for payments will result in immediate termination of your GamezAddict Account, forfeiture of any prizes to which you are otherwise entitled, and civil and / or criminal prosecution.
You may a register as a user with the GamezAddict Website without having to pay to participate in certain games. However, the Company will charge entry fees for other contests or tournaments available on the GamezAddict Website. You must be a user registered with the GamezAddict Website and pay the entry fees to participate in such contests or tournaments. As the holder of the GamezAddict Account, you are responsible for all charges incurred, including applicable taxes, and all usage and purchases made via your GamezAddict Account.

8.2 Deposits and Withdrawals
The Company makes available various payment mechanisms (the “Payment Mechanisms”) on the GamezAddict Website to allow you to access and use the GamezAddict Services. You need to choose your preferred Payment Mechanism in order to deposit monies into and withdraw monies from your GamezAddict Account. The Company reserves the right to impose charges for deposit and withdrawal transactions. Currently available Payment Mechanisms and other information regulating deposits and withdrawals are published in the Game Play Section of the GamezAddict FAQs.

8.3 Refunds
Subject to any withdrawal right you may have under applicable law, deposits are non-refundable unless expressly stated otherwise. Except as otherwise required by law, the costs of any returns if permitted will be at your expense.

8.4 Currency Exchange, Taxes and Other Charges and Fees
Currency exchange settlements will be based on your selected Payment Mechanism and may be determined by agreements between you and the relevant financial institution, credit card issuer or other provider of your chosen Payment Mechanism (“Payment Mechanism Provider”). You are responsible to bear the cost of any currency exchange as well as any charges or fees imposed by your chosen Payment Mechanism. If the Company does not receive payment from your Payment Mechanism Provider, you agree to pay all amounts due to the Company upon demand. Entry fees and prices for products, software and services offered on the GamezAddict Website and / or the GamezAddict Services exclude all applicable taxes and telecommunication charges, unless expressly stated otherwise. You agree to be responsible for any applicable taxes and telecommunication charges, whether or not such amounts are identified on your GamezAddict Account or charged to you by your Payment Mechanism Provider.

9. Use of Communication Services

9.1 The GamezAddict Website may contain e-mail services, bulletin board services, chat areas, news groups, forums, groups, personal web pages, calendars, photo albums, file cabinets and / or other message or communication facilities designed to enable you to communicate with others (collectively, the “Communication Services”). You agree to use the Communication Services only to post, send and receive messages and materials that are proper and, when applicable, related to the particular Communication Service. By way of example, and not as a limitation, you agree that when using a Communication Service, you will not:

Use the Communication Service in connection with surveys, contests, pyramid schemes, chain letters, junk e-mail, spamming or any duplicative or unsolicited messages (commercial or otherwise);
Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others;
Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, obscene, indecent or unlawful topic, name, material or information;
Publish, post, upload, distribute or disseminate any topic, name, material or information that incites discrimination, hate or violence towards one person or a group because of their belonging to a race, a religion or a nation, or that insults the victims of crimes against humanity by contesting the existence of those crimes;
Upload, or otherwise make available, files that contain images, photographs, software or other material protected by intellectual property laws, including, by way of example, and not as limitation, copyright or trademark laws (or by rights of privacy or publicity) unless you own or control the rights thereto or have received all necessary consents to do the same;
Use any material or information, including images or photographs, which is made available through the GamezAddict Website in any manner that infringes any copyright, trademark, patent, trade secret, or other proprietary right of any party;
Upload files that contain viruses, trojan horses, worms, time bombs, cancelbots, corrupted files, or any other similar software or programmes that may damage the operation of another's computer or property of another;
Use meta tag searches ;
Advertise or offer to sell or buy any goods or services for any business purpose, unless such Communication Service specifically allows such messages;
Download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally distributed in such manner;
Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded;
Restrict or inhibit any other user from using and enjoying the Communication Services;
Violate any code of conduct or other guidelines that may be applicable for any particular Communication Service;
Harvest or otherwise collect information about others, including e-mail addresses;
Violate any applicable laws or regulations;
Create a false identity for the purpose of misleading others;
Use, download or otherwise copy, or provide (whether or not for a fee) to a person or entity any directory of users of the GamezAddict Website or other user or usage information or any portion thereof.

9.2 The Company has no obligation to monitor the Communication Services. However, the Company reserves the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. The Company reserves the right to terminate your access to any or all of the Communication Services at any time, without notice, for any reason whatsoever.

9.3 The Company reserves the right at all times to disclose any information as the Company deems necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in the Company’s sole discretion.

9.4 Always use caution when giving out any personally identifiable information about yourself in any Communication Service. The Company does not control or endorse the content, messages or information found in any Communication Service and, therefore, the Company specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Service. Managers and hosts are not authorised spokespersons of the Company, and their views do not necessarily reflect those of the Company.

9.5 Materials uploaded to a Communication Service may be subject to posted limitations on usage, reproduction and/or dissemination, and you are responsible for adhering to such limitations if you download the materials.

9.6 The Company does not claim ownership of the materials you provide to the Company (including feedback and suggestions) or other materials posted, uploaded, inputted, provided or submitted to the GamezAddict Website for review by the general public, or by the members of any public or private group, (each a “Submission” and collectively “Submissions”). However, by posting, uploading, inputting, providing or submitting (a “Posting”) your Submission you are granting the Company, and its suppliers and licensors permission to use your Submission in connection with the operation of their Internet businesses (including, without limitation, the GamezAddict Website), including, without limitation, the license rights to:

9.8 By Posting a Submission you warrant and represent that you own or otherwise control all of the rights to your Submission as described in these Terms and Conditions including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions.

9.9 You agree that the Company has no responsibility or liability for the deletion, corruption or failure to store any Submissions or other content maintained or transmitted by the GamezAddict Website.

10. Third Party Websites

10.1 The GamezAddict Website may contain images of and links to third party web sites (the “Linked Sites”). The Linked Sites are not under the control of the Company. The Company is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. The Company is not responsible for webcasting or any other form of transmission received from any Linked Site nor is the Company responsible if the Linked Site is not working appropriately. You are responsible for viewing and abiding by the privacy statements and terms of use posted at the Linked Sites.

10.2 Any dealings with third parties (including advertisers) included within the GamezAddict Website or participation in promotions, including the delivery of and the payment for goods and services, and any other terms, conditions, warranties or representations associated with such dealings or promotions, are solely between you and the advertiser or other third party. The Company shall not be responsible or liable for any part of any such dealings or promotions.

11. Property Rights

11.1 Your establishment of a GamezAddict Account, your access to or use of the GamezAddict Website and / or the GamezAddict Services confirms your acknowledgement and acceptance that the entire content and material contained in the GamezAddict Website is the protected property of the Company, its suppliers and its licensors.

Your use of the Software is governed by these Terms and Conditions and the terms of the end user license agreement, if any, which accompanies or is included with the Software (the “License Agreement”). You may not install or use any Software that is accompanied by or includes a License Agreement unless you first agree to the License Agreement.

11.4 For any Software not accompanied by a license agreement, the Company hereby grants to you a revocable personal, non-transferable license to use the Software for viewing and otherwise using in accordance with these Terms and Conditions, and for no other purpose provided that you keep intact all copyright and other proprietary notices. Any reproduction or redistribution of the Software is expressly prohibited by law, and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible. Without limiting the foregoing, any copying or reproduction of the Software for further reproduction or redistribution is expressly prohibited. You acknowledge that the Software, and any accompanying documentation and / or technical information, is subject to the relevant applicable export control laws and regulations.

11.5 You acknowledge that the features, parameters, specifications or existence of the GamezAddict Website and / or the GamezAddict Services or any part thereof may change at any time without notice.

12. No Unlawful or Prohibited Use

12.1 You agree not to use the GamezAddict Website and / or the GamezAddict Services for any purpose that is unlawful or prohibited by these Terms and Conditions. You may not use the GamezAddict Website in any manner that could damage, disable, overburden, or impair the GamezAddict Website (or the Linked Sites) or interfere with any other party's use and enjoyment of the GamezAddict Website. The Company reserves the right to suspend or terminate your access either temporarily or permanently in such event, in addition to pursuing any other rights available to the Company.

12.2 The Company may, in addition to pursuing any other rights available to the Company, immediately terminate any GamezAddict Account which it determines, in its sole discretion, to be transmitting or is otherwise connected with any “spam” or other unsolicited bulk e-mail. In addition, you agree to pay the Company liquidated damages of five dollars (USD5.00) for each piece of “spam” or unsolicited bulk e-mail transmitted from or otherwise connected with your GamezAddict Account.

13. Representations

13.1 The information, products, software and services included in or made available through the GamezAddict Website may include inaccuracies or typographical error. Amendments and improvements are made to the GamezAddict Website and the GamezAddict Services from time to time. The Company and / or its suppliers and licensors may make such amendments and improvements at any time. Any advice received via the GamezAddict Website should not be relied upon for personal, medical, legal or financial decisions and you must consult an appropriate professional for specific advice that meets your circumstances.

13.2 The Company and / or its suppliers and licensors make no representations relating to the suitability, reliability, availability, timeliness, lack of viruses or other harmful components, or accuracy of the information, products, software and services included in or made available through the GamezAddict Website for any purpose.

14. No Warranty

14.1 The GamezAddict Website and the GamezAddict Services are provided by the Company on an “as is” and “as available” basis, without any warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, workmanlike effort, title or non-infringement. No person affiliated, or claiming affiliation, with the Company has the authority to extend such warranties.

14.2 The Company does not warrant that the GamezAddict Website and / or the GamezAddict Services will be uninterrupted, timely, secure or error-free.

14.3 The Company does not guarantee that you will be able to access or use the GamezAddict Website at times or locations of your choosing or that the Company will have sufficient capacity for the provision of the GamezAddict Website and / or the GamezAddict Services as a whole or in any specific location.

15. Limited Liability

15.1 By establishing a GamezAddict Account or participating in any of the GamezAddict Services, you agree to hold the Company, its suppliers and / or licensors harmless with respect to any loss, damages, injury related from use, access or attempted use or access to the GamezAddict Website, and you specifically agree that the Company shall not be responsible or liable for:

If you are dissatisfied with any portion of the GamezAddict Website or and any information, products, software and services offered therein, your sole and exclusive remedy shall be to discontinue using the GamezAddict Website.

15.3 In the event of any failure with respect to game delivery and / or completion for any reason, then, after evaluating the cause of the failure and determining with certainty that the responsibility for such failure lies completely within the Company, the Company may at its option (but not the obligation) to refund to your GamezAddict Account up to the equivalent in cash fees paid by you to join a particular contest or tournament.

16. Indemnities

16.1 By registering on the GamezAddict Website and / or participating in any of the GamezAddict Services, you agree to indemnify, defend, and hold the Company, its parents, subsidiaries, affiliates, suppliers, licensors, officers and employees harmless from or for any claims, demands, liability, damages, and / or costs (including attorney fees) due to or arising from any use of your GamezAddict Account by any person or from your conduct on the GamezAddict Website.

17. Termination of GamezAddict Account

17.1 Either you or the Company has the right to terminate or cancel your GamezAddict Account at any time. You understand and agree that the cancellation of your GamezAddict Account is your sole right and remedy with respect to any dispute with the Company. This includes, but is not limited to, any dispute related to, or arising out of:

Any term of these Terms and Conditions, or the Company’s enforcement or application of these Terms and Conditions;
Any information, products, software and services available on the GamezAddict Website or any change thereto;
Your ability to access and / or use any information, products, software and services available on the GamezAddict Website; or
The amount or type of fees, surcharges, applicable taxes, billing methods, or any change to the fees, applicable taxes, surcharges or billing methods.

17.2 You can cancel your GamezAddict Account by delivering notice to the Company’s Customer Service Department at support@gamezaddict.com. The Company may collect fees, surcharges or costs incurred before you cancel your GamezAddict Account. In addition, you are responsible for any charges incurred to third-party vendors or content providers before your cancellation. In the event that your GamezAddict Account is terminated or cancelled, no refund will be granted; no online time or other credits (e.g., points in an online game) will be credited to you or converted to cash or other form of reimbursement. Any delinquent or unpaid GamezAddict Account with unresolved issues with the Company must be settled before you are allowed to register again.

17.3 The Company reserves the right to terminate your GamezAddict Account or limit of your participation in any tournament for any reason, including but not limited to, harassment of other participants, posting of objectionable material, creation of multiple accounts, fraudulent deposits or withdrawals, game fraud, technical failure fraud, suspected fraud, providing misleading information or any breach of these Terms and Conditions. All winnings will be forfeited in the event of such an occurrence.

17.4 Any attempt to gain unauthorised access to the GamezAddict Website and / or the GamezAddict Services or the Company’s systems or any GamezAddict Account, any interference with the procedures or performance of the GamezAddict Website, any use of unauthorised third party or external programmes, any alteration to the outcome or performance of a game, contest or tournament, or any deliberate damage or undermining of the GamezAddict Website and / or the Company shall be subject to civil and / or criminal prosecution and will result in immediate termination of your GamezAddict Account and forfeiture of any prizes and / or deposits to which you are otherwise entitled.

17.5 By registering for a GamezAddict Account and / or participating in any contest or tournament offered the GamezAddict Website, you consent to allow the Company to access your GamezAddict Account information to investigate complaints and / or other allegations of abuse.

18. Electronic Notices

18.1 All information that the Company is required to send to you regarding your use of and access to the GamezAddict Website and the GamezAddict Services will be provided to in electronic form only. The Company will provide all such information to you via the e-mail address that you have specified during registration or via notice posted on the GamezAddict Website.

18.2 The establishment of a GamezAddict Account, the use of the GamezAddict Website and / or the GamezAddict Services confirms your consent to receive all such information by electronic communication only. You also confirm that your personal computer satisfies the technical requirements stated in these Terms and Conditions for receiving, accessing, displaying, printing and storing copies of such information, and you further confirm that you have provided the Company with a current e-mail address for such purpose.
